Affiliate Program Terms and Conditions
Our affiliate program is designed to help you generate income in exchange for referring new hosting clients to our company. Listed below are the terms and conditions associated with our affiliate program.
Payment
• Affiliates are paid a one-time 60% commission up to $150 USD for each hosting account referred to our services. A signup is counted when a customer first clicks on an affiliate referral link and completes the signup process.
• Affiliate accounts must be active at the time of the referral. No credit will be given to your affiliate account for sales that occurred before you joined the affiliate program.
• If a referral has been made and is not showing in your affiliate account it must be reported within 15 days. Missed referrals not reported during this period will not be credited to your account.
• All affiliate fees are locked 90 days after the sale occurred. Payments are then processed and sent out upon your request. Once your payment has been processed its status will change from pending to sent.
• Affiliates must generate a balance of $100 or more before their account is eligible for payment.
• Payments are sent using the PayPal mass payment system and no fees are deducted from your earnings. If you do not supply a PayPal address a check will be sent. Payments by check take up to an additional 30 days to arrive. For larger affiliates with balances of over $10,000 per month we offer Wire Transfer.
• Affiliates are responsible for ensuring that all payee information is up to date in the affiliate system. We are not responsible for lost or stolen payments. Failure to provide current information may result in forfeiture of commissions due to you.
• Commissions that are left unclaimed or are returned for invalid or insufficient address information or for other reasons may be forfeited.
• There is a $35 charge to re-issue payment and it will be deducted from affiliate earnings. Payments will only be reissued within 120 days of the original issue date. After 120 days the payment will be forfeited.
• Affiliates are responsible for making sure they are able to accept payments and for any fees, taxes, exchange rates, surcharges, and other expenses incurred to receive commissions.
• Tax information is required to be on file in order for you to be paid. Tax forms need to be completely filled out and signed.
• It is the affiliate's responsibility to provide a valid tax form within 90 days of a commission being earned. If the tax form has not been received the commission will be forfeited and no payment will be issued.
• Affiliates are required to refer at least 3 new paid customers per year to qualify for commission withdrawal.
• Affiliates are paid a maximum of 1 year commission for each hosting account referred to our services.
Pay Plans
• Affiliates are paid 60% of what we charge when a customer signs up.
• The commission plan applies to all hosting plans. Add-ons, domain name purchases, and domain name transfers are excluded.
• Affiliates are paid $5 for each Free Trial account they refer. This $5 will not be available until the affiliate account has a conversion rate of 10% or above, meaning 10% or more of the referred free-trial clients become paying customers.
Reversals
• Referrals must have an active hosting account for 90 consecutive days or commissions will be reversed.
• Referrals that downgrade their hosting package will be reversed.
• Referrals found to be fraudulent will be reversed regardless of the time that has passed since signup.
• Referrals that issue a credit card chargeback will be reversed.
• Referrals that cancel before you have met the $100 payout minimum will be reversed.
• Customers using non-standard rates may not be eligible for affiliate commissions. Non-standard rates include sales, promotions, email offers, prepaid accounts, and discounted pricing offered for educational, government, nonprofit, and charity organizations.
Advertising Compliance
• Affiliates MAY NOT offer cash back, rewards, or incentives.
• Affiliates MAY NOT bid on trademark, trademark-plus, or misspelled keywords for PPC on search engines.
• Affiliates MAY use approved banners and ad text code found in the affiliate management center.
• Affiliates are responsible for ensuring tracking code works properly before sending traffic. Commissions will not be paid for tracking errors caused by editing, masking, or tampering with links.
• Affiliates MAY NOT use cookie stuffing techniques that set the tracking cookie without the user clicking the referral link.
• Redirected pages and links used to send a user to our site are prohibited.
• Domain forwarding is prohibited.
• Affiliates MAY NOT copy our website or portions of it and display them on their own site or subdomain.
• Affiliates MAY NOT advertise on business-opportunity sites or use marketing practices that attract fraudulent or short-term customers.
FTC Disclosure Policy
It is our intent to treat our customers fairly and comply fully with all Federal Trade Commission regulations related to advertising. We require our affiliates to comply with these regulations.
This includes Federal Trade Commission 16 CFR Part 255, which requires that material connections between advertisers and endorsers be disclosed.
Directories, review and rating sites, blogs, websites, email, or collateral that provide an endorsement or assessment of an advertiser must prominently disclose that financial or in-kind compensation is provided from the advertiser.
The FTC Disclosure page in the affiliate account is intended to provide guidance, not legal advice, and does not guarantee compliance. You are advised to obtain your own legal advice.
We reserve the right to withhold commission fees and/or cancel the affiliate relationship for failure to comply with FTC regulations.
Deactivation
• Affiliate accounts may be deactivated at any time without warning or notice. Accounts and commissions will be set to $0 for failure to comply with these Affiliate Terms and Advertising Compliance requirements.
• False or misleading advertising or suspected fraudulent activity will result in immediate deactivation.
• Affiliate accounts generating a large number of fraudulent accounts will be deactivated.
• Affiliates may not resell hosting. All clients must provide their own payment method and contact information to be eligible for commissions.
• To discontinue affiliate status, remove your affiliate links and stop promoting them. For accounting purposes, your account and personal information will not be removed from our system.
Agreement and Changes
BY REGISTERING AS AN AFFILIATE YOU ARE AGREEING TO THE TERMS AND CONDITIONS. IF YOU DO NOT AGREE, YOU MUST DISCONTINUE THE REGISTRATION PROCESS, DISCONTINUE YOUR USE OF THE AFFILIATE PROGRAM, OR DEACTIVATE YOUR ACCOUNT IF YOU ARE ALREADY A MEMBER.
Changes to the Terms and Conditions apply to you. SharkASP.NET may change these Terms and Conditions, in whole or in part, at any time at its sole discretion. Posting changed Terms and Conditions on the site constitutes notice of such changes.
SharkASP.NET will use reasonable efforts to provide 7 days advance notice of changes that materially and adversely impact use of the Affiliate Program. Continued use following notice constitutes acceptance.
